HaiHi I’m Tree and need some help.
This is the scoop.
My Uncle Terry passed a few months back..
He was married to Billie.
When he died his asset or estate was divide in 1/2.
One half to Billie the other to my grandma.
My Grandma passed away near the end of Oct.
Uncle Terry did not have a will, nor did he have any childern.
How did Grandma get 1/2 of the estate if thier was no will.
Wouldn’t Billie got it all? Now Grandma gone and the medicare asking to be paid $200,000 for taking care of her in a home.
Or this is what he saying.
He sent me and my cousin papers to get out brothers and sisters to sign giving up our rights to inhertence.
Saying that after medcade takes thier share thier be nothing.
(What makes it so bad he calls about this paper and drop them off at our store for me to pick up and give to my cousins on the day of funrial of thier father.

Uncle Joe was married to my Aunt Shirley who passed away with cancer 5 years ago.
My dad had 6 brothers and sisters.
The other 4 are still living.
But us cousin would be inhertant our father and Aunt shirley part..
Because none of us would not sign the papers estate going to be handle by a lawyer now.
My mom talk to uncle Kenneth he gave a run around on her ?”s Cousin Eric said he talked to our anut who said the paper needed tobe signed so they could sale the house (Terry’s) So Billie could have the money.

RaleighWhew I’m confused… Let me see what I can do to figure out some of what you typed.
First is Uncle Terry the son of grandma? I”m going to assume so… If I’m wrong stop reading and write me back immediately.
Secondly is Aunt Billie still living? Could it be that Aunt Billie just gave to grandma? It would stand to reason that although Terry didn’t have a will, all of his assets went to Billie and she was being charitable.
Secondly, what does grandma own? Anything of her own, or what Aunt Billie Gave her? Thirdly, Medicaid is enforcing something called Estate Recovery…
Where they get reimbursed for the expenses they incurred after the person is deceased. Your grandmother, and her guardians were notified of this when they applied for Medicaid benefits acceptance of benefits, entitles them to recover. This was set up so that people who could remain in their homes and communities could benefit from that as opposed to selling all of their assets and being declared indigent and moved into a skilled nursing facility. Sometimes the declaration or the selling of all tangible assets is too much to bear for the older individual and it hastens their departure. While it might not seem fair, people had the same cry when grandma was still living and they couldn’t afford her care, why should she have to sell off everything before we can receive help? The work around, albeit late in your case, was to
transfer all of her assets before conceivable incapacity to another family member. Since that wasn’t done in your case, they do have legal claim to what she has. Oooh and they have claim, only after her final expenses have been paid. If she lived in a house, the power bill gets paid, the gas bill, phone bill, mortgage etc. Her funeral can be paid from her assets etc, then Estate Recovery comes in.
Now she might not have had anything, I can’t determine that from your post.

FredrickCould it be that Aunt Billie just gave to grandma? No she didn’t by what Uncle Kenneth says.
He said Because Terry did not have a will she got 1/2 and Grandma got 1/2.
That why I was puzzled.
with her childern, then in a apartment, then the home after her fall.

But when ask questions he gives runaround answers.

HymanTree, This is all so very confusing. I think I’d get an estate attorney to look over all the paperwork and see what it says. Hopefully you can find someone to help untangle the confusion.

Grandma had nothing, medicaid gets nothing! So like your doing, don’t sign a doggone thing. Signing would indicate that grandma had something.
No way grandma got half of anything without a will so what Uncle Terry supposedly left her, is legally Aunt Billie’s.

DonnellActually, from my understanding it doesn’t matter where the money came from for the Medicaid Estate recovery.
If the money was in her account, it would be considered hers.
She should have had a medicaid caseworker.
If you have questions, I would suggest you contact him or her for the specifics on how things work in your state, as each state is somewhat different.

KeenanI’m lost on the details here.
The bottom line is if you’re worried about getting ‘what’s owed’ to you from the estate(s?) then you need a lawyer for yourself.
Find one that knows estate law and understands the medicare/medicade implications as well (should be any of them).
You indicated that there is an attorney involved already for the aunt or cousins.
If you are not benefiting or going after a piece of the estate, consult that attorney and if you trust what you are being told by that person, follow that advice.
However if you are involved in the estate, remember that that attorney is retained by another party.
